Criminal Law FAQ

This page answers common questions about criminal law, but is not meant to replace consultation with criminal defense attorneys. If you face criminal charges in the state of Maryland, you need legal help. Contact criminal defense lawyers to represent you immediately.

What is criminal law?

Criminal law is about the laws and institutions needed to protect society from harm. Such laws concern crimes that are committed against the public or public authority. These differ from civil law, which involve laws that define the rights and procedures that are needed to settle disputes between different parties, and usually do not involve the public as a whole.

Why should I hire a criminal defense lawyer?

An experienced criminal attorney understands the ins and outs of not only criminal law, but also court procedure and the individuals who will hear your case. Such crucial knowledge can help your legal defense. Also, many judges will not consider a plea bargain from a defendant without legal representation.

What should I do if I am arrested?

Answer any questions the authorities ask you about your identification truthfully. You do not need to answer self-incriminating questions, but do not make things harder on yourself by lying. Ask for a criminal defense attorney, and do not answer any questions until one is present.

What should I do if a family member or other loved one has been arrested?

Gather as much information about the arrest as possible, and write it all down. This should include:

  • Name, birth date, and Social Security number of the arrested individual
  • The specific charges
  • The arresting law enforcement agency
  • The place the person is being held
  • The amount of bail, if it has been set

What punishments do I face if convicted?

This varies greatly based on the crime, jurisdiction and judge, but the most common punishments for a criminal conviction include:

  • Time in jail, prison, or another detention facility
  • Fines
  • Restitution (compensation made to the victim)
  • Probation
  • Community service

Many other penalties may be specific to a criminal case, such as driving sanctions, treatment and classes in a DUI case.
